Attached please find the State Environmental Policy Act (SEPA) Notice of Action (NOA), for LU16-0098, Proctor South Development. This NOA states that the City has issued the site development permit for Proctor South effective today. This initiates the SEPA appeal period on LU16-0098, a Revised Mitigated Determination of Nonsignificance that the City issued on December 14.
The project is a 141-unit mixed use building which will occupy a half-block area, and which will be 65 feet tall.
Under SEPA, the City held a 30-day public comment period and a public informational meeting regarding the project. Multiple public comments were received and reviewed, and a response memorandum was prepared. The comment period ended on November 2, 2016.
In summary, a review of the building permit plans showed that the building meets all applicable land use and zoning codes. However, it was determined that mitigation under SEPA was warranted. The initial MNDS (issued October 3) required confirmation of soil cleanup, traffic mitigation and pedestrian design enhancements, intersection / traffic light improvements, and transit support.
Following the public comment period and additional review, additional mitigation was required. The applicant will post a $25,000 bond for one year after occupancy to address traffic calming measures in the neighborhood. In addition, the applicant will be required to modify the west façade of the building to modulate, screen, or beautify the foundation until such time as the landscaping buffer matures.

The City is continuing to review the additional permits for the development (the Work Order and Building Permits) and expects to issue those permits in the coming weeks.
